TERMS OF SERVICE
Southern Creative provides World Wide Web page hosting.  Southern Creative reserves the right to suspend or cancel a customer's access to any or all services provided by Southern Creative when Southern Creative decides that the account has been inappropriately used or otherwise.

SERVER USE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of there website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include advertising banners, classified advertisements, and personal advertisements.

Southern Creative reserves the right to refuse service and/or access to its servers to anyone.

Southern Creative do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Government or local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Southern Creative.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, and password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

SERVERS
Southern Creative will not be held responsible for any loss of data or content on their server/s. It is the responsibility of the client using the Southern Creative hosting facilities to backup data on a regular basis.

BACUP ROUTINES

UNLIMITED USE POLICY
High bandwidth usage: Southern Creative offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Southern Creative may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Southern Creative reserves the right to impose the High Resource User Policy for the consideration of all customers.
Clients may not use the server as an FTP transfer system for business to business services. This type of use will result in the domain being shut down without notice.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilisation.Southern Creative may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available Southern Creative reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Southern Creative continues hosting the website for an additional fee. 

EMAIL SERVICES
Our email facilities provide up to 5 email addresses for business purposes. Additional email facilities are available on a BUSINESS 20 ACCOUNT

ACCOUNT TYPES

  • Business 20 provides up to 20 email addresses for the small business
  • Business 50 provides up to 50 email addresses for the medium sized business

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although Southern Creative reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

In addition, Southern Creative reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made or before the renewal is due.

PAYMENT AND SERVICES
Southern Creative cannot guarantee that a service will be provided or continued until all payments have been received.

CANCELLATION AND REFUNDS
All fees paid are non refundable, if the client chooses to cancel within the annual hosting period or if Southern Creative chooses to cancel under the terms of server misuse.
Any cancellation must be made in writing 2 weeks prior to the hosting renewal date to confirm the cancellation of the rollover renewal process.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold Southern Creative harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Southern Creative, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Southern Creative against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Southern Creative's server; (2) any material supplied by a customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Southern Creative's server.


DISCLAIMER
Southern Creative will not be responsible for any damages your business may suffer. Southern Creative makes no warranties of any kind, expressed or implied for services we provide. Southern Creative disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by Southern Creative and its employees. Southern Creative reserves the right to revise its policies at any time.

CONTENT BACKUP
It is recommended that regular data backups are made by the client of their web content.  Southern Creative is not responsible for any content held on the provided servers. Lost content must be reloaded by the client unless otherwise agreed with Southern Creative.

Please allow a maximum of 24 hours for a support reply.

Support will be given to a web development agency only if prior agreement has been made by the client with Southern Creative. Only support for the server setup will be offered. No support for development can be offered.

domain management terms

Any domain name purchased on by or on behalf of any client will be managed and controlled by Southern Creative Media Group.

Any requests for transfer of a domain to another management company will incur a minimal administration fee if the cancellation is within the annual term of the domain name.

Any cancellation of a domain must be submitted over 2 weeks prior to its expiry date to release the domain on the expiry date without charge.

Any domain unlocked is done so for upto 7 days once a request has been made.

Any domain purchased on behalf of a client but without the clients full information will be done so as a Southern Creative purchase and as such will be owned by Southern Creative

Any domain held by Southern Creative will be pointed to a Southern Creative server for all hosting services of that domain.
